BaFin Requirements Knowledge
Status first β most of this was repealed in favour of DORA
BaFin withdrew its IT circulars to avoid double regulation with DORA. Establish
this before giving any BaFin advice:
| Circular |
Status |
| VAIT (insurance) |
Repealed β end of 16 Jan 2025 |
| KAIT (capital management) |
Repealed β end of 16 Jan 2025 |
| ZAIT (payment services) |
Repealed β end of 16 Jan 2025 |
| BAIT (banks) |
Phasing out. Institutions subject to DORA Art. 5β15 or Art. 16 left BAIT scope on 16 Jan 2025 (Chapter 11 repealed outright). Full repeal 31 Dec 2026. |
| MaRisk |
In force β 9th amendment, Rundschreiben 06/2026 (BA), published 30 Jun 2026 |
The only live XAIT question today: smaller institutions not yet in DORA
scope must still follow BAIT until 31 Dec 2026; DORA reaches them on
1 Jan 2027 via FinmadiG. For every other entity the answer to "how do we
comply with BAIT / VAIT / KAIT / ZAIT?" is DORA.
Never propose VAIT, KAIT or ZAIT as a separate framework, wizard or assessment
in this application. If a user names one, say the circular is gone and route
them to DORA β see DORA_REFERENCE.md.
MaRisk (9th amendment β Rundschreiben 06/2026 BA)
The live German circular for risk management, deliberately principles-based and
slimmed down, with explicit DORA demarcation:
- AT 7.2 (technisch-organisatorische Ausstattung / ICT) β largely dropped.
ICT risk and ICT third-party management now sit with DORA. Do not cite
AT 7.2 as the basis for an IT requirement any more.
- AT 9 (outsourcing) β retained, with an explanatory block drawing the DORA
boundary. Sub-outsourcing reporting duties toward the originating institution
were clarified.
- ICT strategy is positioned as the bridge between business strategy and the
DORA digital-operational-resilience strategy.
- More proportionality, with extra relief for small and very small banks.
β οΈ The 9th amendment restructured the circular. The module nomenclature
(AT β¦, BTO, BTR) survives, but content moved β verify any module number taken
from the older 06/2024 MaRisk against Rundschreiben 06/2026 before quoting it.
Still-useful ISO mappings:
- AT 9 β ISO 27001 A.5.19βA.5.23, DORA Art. 28β30
- Business continuity β ISO 27001 A.5.29, A.5.30 (β bcm-specialist)
BAIT β only for institutions outside DORA scope (until 31 Dec 2026)
Applies to the shrinking group of smaller institutions that DORA does not yet
cover. For anyone else this section is historical context, useful only to
explain what an existing BAIT-shaped control set maps onto.

Repealed circulars β what they were, what replaced them
Keep only enough to recognise a user's legacy vocabulary and redirect:
- VAIT (insurers, ~90 % structural overlap with BAIT, Solvency II ties) β DORA
- KAIT (asset managers; portfolio, NAV and client-reporting systems) β DORA
- ZAIT (payment institutions; PSD2, SCA, transaction monitoring, API security) β DORA
(PSD2/SCA obligations themselves live on β they come from PSD2, not from ZAIT.)

- Two catalogue generations are assessable in parallel β VDA-ISA 6
(framework code
TISAX, 80 requirements) and VDA-ISA 2027 (code
TISAX-2027, 78 requirements). Never call ISA 6 obsolete and never push a
migration. Establish which generation the user's scope names first.
- Requirement text is never shipped. ISA 6 is copyrighted ENX/VDA
material; ISA 2027 is CC BY-ND 4.0 with a Section 9 restriction, so even a
reworded or translated catalogue is off-limits. The app ships numbers,
structure and mappings only β users bring their own licensed workbook
through the import wizard (
requiresUpload: true on both fixtures). Explain
intent in your own words; do not quote the catalogue.
- It is a label, not a certificate. Say "assessment result" / "label".
- No official German edition of ISA 2027 exists β do not invent German
requirement titles.
Version fingerprint (from TisaxCatalogueVersionDetector), for when a user
pastes numbers without naming a generation:
- ISA 2027 only:
6.1.3, 8.1.9β8.1.13
- ISA 6 only:
1.2.4, 8.3.1, 8.3.2, 8.4.1β8.4.3, 8.5.1, 8.5.2
Reuse angle: shipped mappings connect both generations to ISO 27001:2022,
BSI IT-Grundschutz, NIS2, NIST CSF 2.0/SP 800-53r5 and IEC 62443, plus an ISA 6
β ISA 2027 crosswalk. Always check whether existing ISO/BSI evidence already
covers a requirement before proposing new work.
Data Reuse Patterns & Workflow Optimization
Core Data Reuse Principles
1. Single Source of Truth
- Assets defined once, reused across:
- Risk assessments
- Control implementations
- Business processes
- Incident management
- Compliance mappings
2. Transitive Compliance
- Implement ISO 27001 control β Automatically fulfill:
- Multiple DORA articles
- NIS2 measures
- BaFin requirements
- Example: A.8.5 (Secure authentication) covers:
- DORA Art. 9 (Protection)
- NIS2 Art. 21(2)(h) (Authentication)
- BAIT 2.2 (Access control) β only for institutions still outside DORA scope
3. Evidence Reuse
- Single document serves multiple purposes:
- ISO 27001 A.5.1 (Policy)
- DORA Art. 6(8) (Documentation)
- NIS2 Art. 21(2)(a) (Policy requirement)
- BaFin BAIT 2.2 (IS policy) β only outside DORA scope; otherwise DORA Art. 5
Optimized Workflows
Statement of Applicability (SoA) Workflow
Initial Assessment (Bulk mode)
- Review all 93 controls in one session
- Mark applicability (applicable/not_applicable)
- Provide justification for not-applicable controls
- Time saved: ~70% vs. one-by-one approach
Implementation Planning
- Filter: Show only "applicable + not yet implemented"
- Prioritize by: Risk coverage, framework requirements, quick wins
- Assign owners in bulk
Evidence Collection
- Link documents to multiple controls at once
- Use document tags for auto-linking
- Share evidence across frameworks
Verification
- Schedule verification dates in bulk
- Generate verification checklists

NIS2 Compliance Workflow
When user asks: "How do we comply with NIS2?" or "NIS2 implementation"
Response:
Scoping
- Check if entity is "essential" or "important"
- Verify size threshold (β₯50 employees OR β₯10Mβ¬ turnover)
- Register with BSI (if in scope)
Gap Analysis (Article 21 measures)
- Navigate to:
/compliance/framework/{nis2-id}

- Export compliance report:
/compliance/framework/{nis2-id}/export
- Prepare for BSI inspections (if applicable)
Deadline: October 17, 2024 (Member State implementation) + 21 months (grace period)
BaFin Compliance Workflow (DORA-first)
When user asks: "How do we comply with BAIT?", "VAIT requirements", or
"BaFin IT requirements"
Step 0 β correct the premise before answering. VAIT, KAIT and ZAIT were
repealed on 16 Jan 2025; BAIT is fully repealed on 31 Dec 2026. Do not build a
compliance plan around a circular that no longer exists.
Determine which regime actually applies
- Bank, insurer, asset manager, payment institution β DORA + MaRisk
(Rundschreiben 06/2026) for the non-ICT risk-management parts
- Small institution not yet in DORA scope β BAIT until 31 Dec 2026, then
DORA from 1 Jan 2027 (FinmadiG). Ask for the entity type and size rather
than assuming.
- Sector law continues alongside: VAG for insurers, PSD2 for payment
services, KAGB for asset managers β these were never part of the XAIT
circulars and are unaffected.
ICT risk management β DORA Art. 5β15 (or the simplified Art. 16 regime
for smaller entities)
- ISO 27001-based ISMS remains the practical vehicle
- Navigate to:
/soa/ for control implementation
- Detail:
DORA_REFERENCE.md, RTS_ICT_RISK_MANAGEMENT.md
ICT incident reporting β DORA Art. 17β23, with the classification
thresholds and templates in RTS_INCIDENT_REPORTING.md /
ITS_INCIDENT_TEMPLATES.md
- ISO 27001 mapping: A.5.24βA.5.28
ICT third-party risk β DORA Art. 28β30 + MaRisk AT 9
- Critical: cloud services, core banking systems
- Due diligence:
/supplier/ entity with risk assessment
- Register of information:
ITS_REGISTER_OF_INFORMATION.md β this is a hard
DORA deliverable, not an optional list
- Contract requirements: SLAs, audit rights (supervisory access), data
protection clauses, exit strategy, sub-outsourcing transparency
- Mapping: ISO 27001 A.5.19βA.5.23
Resilience testing β DORA Art. 24β27; TLPT only for entities designated
for it (RTS_TLPT.md)
Documentation requirements
- ICT strategy / digital operational resilience strategy (board-approved)
- Information security policy
- Register of information:
/supplier/ with classification
- ICT incident management procedures
- BCM plans (β bcm-specialist)
Audit preparation
- Supervisors expect ISO 27001 certification or demonstrable equivalence
- Export SoA:
/soa/export/pdf
- Evidence repository:
/document/
- Document transitive compliance: show how ISO 27001 controls cover the DORA
articles (the app ships the mappings β reuse them rather than rebuilding)
Supervisory inspection readiness:
- All documentation current (<12 months)
- Audit trail complete (via
AuditLog)
- Register of information up-to-date and submittable
- ICT incident log accessible, with classification decisions recorded
Troubleshooting & Optimization
Common Issues
Issue: "SoA completion is slow - too many controls"
Solution:
- Use bulk mode:
/soa/bulk-update
- Filter by domain:
/soa/category/{domain} - Focus on one domain at a time
- Prioritize by risk: Show only controls linked to high-risk assets
- Quick wins: Mark "not applicable" controls first (with justification)
- Delegate: Assign control groups to different team members
Issue: "Duplicate documentation across frameworks"
Solution:
- Use document linking: Link one document to multiple controls
- Tag documents: Use tags like "policy", "dora", "nis2" for easy filtering
- Export cross-mapping report:
/compliance/cross-framework shows document reuse
- Policy template approach: Create templates that cover multiple frameworks
Issue: "Can't track compliance progress across frameworks"
Solution:
- Use compliance dashboard:
/compliance/framework/{id} for each framework
- Compare frameworks:
/compliance/compare?frameworks=iso27001,dora,nis2
- Set milestones: Target % completion per quarter
- Visual tracking: Heatmap view shows progress by control domain
Issue: "Evidence collection is chaotic"
Solution:
- Create evidence folder structure: Organize by control domain (A.5, A.6, A.7, A.8)
- Use naming convention:
Control_A.5.1_Policy_v1.0.pdf
- Link evidence in bulk: Select multiple controls β Link document
- Evidence matrix: Export list of controls + linked documents
Issue: "Verification schedule is overwhelming"
Solution:
- Risk-based verification: Verify high-risk controls quarterly, others annually
- Combine verifications: Verify related controls together (e.g., all access control controls)
- Use audit program: Plan verification schedule 12 months ahead
- Automate reminders: System sends notifications for overdue verifications
Optimization Tips
Tip 1: Leverage Transitive Compliance
- Implement ISO 27001 first β Automatically covers ~70% of DORA, ~80% of NIS2
- Focus effort on framework-specific gaps (incident reporting, TLPT, etc.)
- Document transitive compliance: Show auditors the control mappings
Tip 2: Automate Evidence Collection
- Integrate document management: Auto-link documents to controls based on tags
- Use templates: Pre-filled templates for common evidence types
- Scheduled exports: Auto-generate compliance reports monthly
Tip 3: Optimize Supplier Management
- Centralize supplier data: One supplier entity serves ISMS, BCM, DORA
- Classify once: Critical/Important classification reused across frameworks
- Contract template: Single template covers ISO 27001, DORA, BaFin requirements
Tip 4: Streamline Incident Management
- Single incident entity serves:
- ISO 27001 A.5.24-A.5.28 (ISMS incidents)
- DORA Art. 17-23 (ICT incidents)
- NIS2 Art. 23 (significant incidents)
- BaFin reporting (if applicable)
- Auto-classify: System suggests if incident is reportable based on criteria
Tip 5: Management Review Efficiency
- Quarterly management review covers:
- ISO 27001 Clause 9.3 (ISMS review)
- DORA oversight requirements
- NIS2 management accountability
- BaFin governance requirements
- Single meeting, multiple compliance checkboxes
